In 2019, when the Whistleblowing Directive entered into force, the European Union imposed minimum standards for the protection of persons who report breaches of the law. The new legislation applies to public and private organisations alike.
In Romania, the Directive created quite a significant impact, because the existing whistleblowing legal framework only covered public entities. Now, the transposition Law no. 361/2022 obliges private companies with a minimum of 50 employees, as well as those which fall under special categories irrespective of size, to set up internal whistleblowing channels and ensure the protection of persons who report breaches (Whistleblowers).
Since the law entered into force, we noticed that Romanian companies encountered difficulties with 3 compliance topics: setting up the internal reporting channel, choosing the right person for handling reports and creating effective Whistleblowing policies.
To better address these challenges, we created a multidisciplinary team together with our long-term partner firm, Biris Goran SPARL. Our expertise combines privacy, employment and whistleblowing legislation, as well as experience in conducting internal company investigations.
